General Terms and Conditions (AGB)

We are delighted that you are interested in a holiday in the ‘Cradle of Switzerland’ adventure region and thank you for the trust you have placed in us. Please read the following General Terms and Conditions of Contract carefully.

1 Scope of application of the General Terms and Conditions

1.1 IG Wiege der Schweiz as provider / organiser

These General Terms and Conditions (hereinafter referred to as ‘GTC’) govern the contractual relationship between the customer and the Swiss Cradle Community of Interest, based in 6460 Altdorf, Schützengasse 11 (hereinafter referred to as ‘Swiss Cradle’), for services subject to a charge or free of charge, for which the Swiss Cradle itself acts as the provider/organiser. These General Terms and Conditions must be accepted by the customer at the time of ordering. The details are regulated in section 3 below.

1.2 Cradle of Switzerland as an intermediary for third-party services

If the Cradle of Switzerland arranges third-party services (e.g. hotel bookings, rooms for events, tickets for excursions, guided tours or events, etc.) for the customer, the contract is concluded directly between the respective third party and the customer. The fact that the contractual relationship in this case exists between the third party and the customer is not affected by any handling of the order process by the Cradle of Switzerland. In any case, the General Terms and Conditions of the respective service provider, which is expressly mentioned in the offers, shall apply. The details are regulated in section 4 below.

2 Website www.wiegederschweiz.ch

2.1 Content of the Cradle Switzerland website

The Cradle of Switzerland operates the website www.wiegederschweiz.ch and offers its own services on this site. The site also offers third parties the opportunity to offer their services. The general data protection provisions at www.wiegederschweiz.ch apply.

2.2 Exclusion of warranty and liability

The Cradle of Switzerland takes every care to ensure the reliability of the information published on its website. However, no guarantee is given for the accuracy, reliability or completeness of the information. Furthermore, the Cradle of Switzerland cannot accept any responsibility for the uninterrupted functioning of the website or for the freedom of the server from harmful components. Any liability on the part of the Cradle of Switzerland arising from access to the elements of the website or their use is excluded.

2.3 Links

The Cradle of Switzerland is neither responsible nor liable for the content or functioning of linked third-party websites. The organisation has no influence on the content of these websites. Consultation of these websites is at the risk of the customer. The respective terms of use, general terms and conditions and data protection provisions of the linked website apply.

3. Sale of package deals through the cradle of Switzerland

In addition to the provisions under 1.1 to 2.3, the following conditions apply to package deals sold by the Cradle of Switzerland:

3.1 Package deal

A package deal exists if the accommodation (at least one overnight stay) is offered together with another tourist service at a total price.

3.2 Terms of payment

As part of a package deal, payment of the total amount for all services is made directly at the accommodation. The prices are quoted in Swiss francs including VAT. The statutory visitor's tax, accommodation tax and, where applicable, the resort tax per person and night are added to the accommodation price and are not included in the stated price.

3.3 Cancellation costs

Third parties are exclusively responsible for the fulfilment of the contract as contractual partners of the customer. The contractual and cancellation conditions of the third parties apply. The Cradle of Switzerland provides no guarantee for the correct fulfilment of the contract by the third party. Any complaints must be addressed exclusively and immediately to the third party.

3.4 Cancellation insurance

The customer is responsible for taking out cancellation insurance.

3.5 Programme changes and cancellation of the package by the organiser

The package offer may be subject to change due to unforeseeable circumstances. In this case, the Cradle of Switzerland and the third-party provider will endeavour to find an equivalent replacement or another suitable solution. In the event of force majeure (natural disasters, unrest, strikes, etc.), official measures, accidents, technical defects, etc., Cradle of Switzerland or the third-party provider may cancel the offer. If the offer is cancelled by Cradle of Switzerland or the third-party provider before the start of the trip, the package price already paid will be refunded to the customer.

3.6 Complaints

If the all-inclusive offer does not comply with the contractual agreement or if this results in damage, the corresponding defect or damage must be reported to the service provider concerned without delay. If no suitable solution could be found at the service provider's premises and the defect could therefore not be remedied or only inadequately remedied, a written complaint must be submitted to Wiege der Schweiz no later than 30 days after the contractually agreed end of the offer. If the complaint is not submitted to the service provider on site and the deadline for submitting a written complaint to the Cradle of Switzerland is not met, all claims shall lapse.

4 Procurement of third-party services

4.1 Third party as organiser and contractual partner of the customer

If the Cradle of Switzerland arranges third-party services (e.g. hotel rooms, transfers, supporting programmes, tickets for excursions, etc.), the contract for the content of the third-party service is concluded between the customer and the relevant organiser. The Cradle of Switzerland is not a party to the contract. Third-party services are subject to the contractual conditions of the service provider.

4.2 Conclusion of the contract with the third party

Offers from third parties on the website or in other means of communication from the cradle of Switzerland are invitations to the customer to submit an offer. By placing an order (in writing, by e-mail, by telephone, by sending the completed input mask or by purchasing at the counter), the customer submits a binding offer to the third party to conclude the contract and accepts the GTC of the Cradle of Switzerland as well as the GTC and cancellation conditions of the third party. If the receipt of the order is subsequently confirmed to the customer (by telephone, in writing, by sending an e-mail or by a system message), this constitutes a confirmation of receipt and order but not yet an acceptance of the offer. The contract with the third party is only concluded when the customer's offer is accepted by the third party and the order is expressly confirmed. The order confirmation is usually made in writing.
If the customer has only sent a non-binding invitation to submit a quotation for a service provided by a third party by sending the completed input screen, the incoming response constitutes a binding offer to conclude a contract with the third party. In this case, the contract with the third party is concluded upon express acceptance by the customer.

4.3 Contract fulfilment and cancellation

The third party is solely responsible for the fulfilment of the contract as the customer's contractual partner. The contractual conditions of the third party are authoritative. The Cradle of Switzerland provides no guarantee for the correct fulfilment of the contract by the third party. Any complaints must be addressed exclusively, immediately and directly to the third party.
In the event of cancellation, the GTC or the cancellation conditions of the third party shall apply.

4.4 Disclaimer

Under no circumstances shall the Cradle of Switzerland be liable for damages incurred by the customer in connection with the service provided by the third party. Any claims for damages must be made directly against the third party.

4.5 Terms of payment

Unless otherwise agreed by the parties in individual cases, selected debit and credit card payments and on-site cash payments in Swiss francs and euros are accepted. The Cradle of Switzerland reserves the right to issue an advance invoice for confirmed services. All prices quoted are in Swiss francs including VAT. Conversion into euros is at the current daily exchange rate.

5 Intellectual property / intellectual property rights

The entire content of the website www.wiegederschweiz.ch, as well as the content in brochures or on city tours visited, is protected by copyright. The owners of the protected elements are either the Cradle of Switzerland or third parties who have authorised the use of the elements by the Cradle of Switzerland. Visitors to the website are not granted any ownership or usage rights to elements of the website or software, in particular no licence to content protected by copyright or trademark law. The elements on the websites are freely accessible for browsing purposes only. Duplication of this material, or parts thereof, in any written or electronic form is permitted only with a specific mention of wiegederschweiz.ch or if no copyright notices or other protected designations are removed and the source is acknowledged. Reproduction, transfer, amendment, linking or use of the www.wiegederschweiz.ch website for public or commercial purposes is prohibited without the prior written consent of the Cradle of Switzerland. The Cradle of Switzerland expressly reserves all rights.

The various names and logos on the websites are generally registered and protected trademarks. No part of the websites is designed in such a way as to grant a licence or a right to use an image, a registered trademark or a logo. Downloading or copying the websites or parts thereof does not transfer any rights in respect of software or elements on the respective website. The Cradle of Switzerland reserves all rights in respect of all elements on the websites, with the exception of rights belonging to third parties.

6 Data protection

The Cradle of Switzerland undertakes to process personal data (data relating to an identified or identifiable person) in accordance with the provisions of Swiss and European data protection legislation. The general data protection provisions under www.wiegederschweiz.ch/datenschutz

7 Common final provisions

7.1 Severability clause

Should any provision of these General Terms and Conditions be invalid in whole or in part, it shall be replaced by an equivalent provision that comes closest to the economic value of the invalid provision. This shall not affect the validity of the remaining provisions.

7.2 Adaptation of these GTC

The Cradle of Switzerland reserves the right to amend these GTC at any time. The currently valid version is published on www.wiegederschweiz.ch and applies to orders placed from the date of publication. The version of these GTCs valid at the time of the order is authoritative.

7.3 Place of jurisdiction and applicable law

The contractual relationship between the cradle of Switzerland and the customer is governed exclusively by Swiss law. Subject to a mandatory place of jurisdiction, the place of jurisdiction for disputes between the cradle of Switzerland and the customer is Altdorf.
